These terms and conditions (“Terms”) apply to orders placed either online, by telephone, in person, or using any other online communication system. Please read these Terms carefully before placing an order as they affect Your rights and liabilities under the law. By placing an order or making a purchase either electronically via the website, by phone, or in person, You agree to be bound by these Terms, including Our Privacy Policy.

 

  1. Definitions and Interpretations

1.1 In these Terms, the following words shall mean:

  • Goods: The items advertised on the Website or any other marketing material purchased by You from Us.
  • Stocked Products: Items Garden Solutions has in stock at the time of order.
  • Special Ordered Products: Items ordered upon Your request, showing a lead time printed on Your order.
  • Intellectual Property Rights: All patents, database rights, copyrights, design rights, trademarks, and other similar rights, whether registered or unregistered, and the right to apply for their protection.
  • Order: The order for Goods placed by You and accepted by Us subject to these Terms.
  • Order Form: The order form submitted by You setting out the Goods You wish to Order.
  • Us, Our, We: Homeandwork Ltd. trading as Garden Solutions, a company registered in Northern Ireland.
  • User: Any person who browses the Website.
  • Website: The website identified by the URL www.gardensolutions4u.com, or any other platform We use in connection with the Goods, such as Facebook or Instagram.
  • You, Your: The person or organization using the Website or buying Goods from Us pursuant to these Terms.

1.2 References to “in writing” include email. Any queries regarding these Terms, the Goods, or Your Order must be made to the Company Address or via the provided Contact Details.

 

  1. Application of these Terms

2.1 These Terms shall apply to the exclusion of any other terms or conditions, and You agree to abide by them.

2.2 We reserve the right to vary these Terms at any time. If so, the updated version will be posted on the Website, and You will be bound by the updated version if You continue to use the Website thereafter.

 

  1. Goods Information

3.1 Homeandwork Ltd. manufactures garden architecture buildings like bespoke garden offices, home office pods, meeting pods, pergolas, bespoke benches, BBQ stations, and many more products from recycled and new materials, including wood, metal, and other accessories necessary for production.

3.2 We do not take responsibility for:

  • Visible or future cracks and holes in wood.
  • Damage resulting from improper use of furniture or any other items provided by the customer.
  • Mechanical damage (e.g., scratches, broken glass, broken handles) or third-party interference.
  • Weather damage to our products or services in events such as floods, storms, heavy snow above 2 inches, lightning, fire, earthquakes, volcanic eruptions, or strong winds. If the Met Office in the UK or Republic of Ireland issues a warning (yellow, amber, or red), we are not responsible for any damage to products or services we provided. It is the customer’s responsibility to protect and secure their goods.

3.3 Sizes, colours, shapes, and patterns shown in offers are approximate. Wood may vary in colour even if the same wax, oil, or paint is used.

3.4 If the Goods You ordered are unavailable in Your requested specifications, We will notify You of available alternatives. Your Order will not be accepted until You confirm an alternative.

3.5 If You provide measurements and the product does not fit, adjustments at the customer’s location are not included. A new product must be ordered, with the original deposit forfeited. A new product may take up to 8 weeks at full price.

3.6 We use materials, equipment, and other items for our products and services that meet the requirements for their intended purpose. For example, to attach OSB boards to timber construction, we may use nails between 30mm and 100mm, screws, or any other suitable fasteners, provided they meet the minimum requirements for the job. This applies to all services and products we provide.

3.7 We take responsibility for:

  • Manufacturing faults.
  • Errors in measurements if We performed the measurement.
  • Damage during transport.
  1. Prices and Payments

4.1 Prices are determined individually based on size and design. Some products have fixed prices, but modifications requested by the customer may affect the final price.

4.2 Payments depend on the product and may be subject to negotiation. Any changes will be highlighted in the contract.

4.2.1 For bespoke products valued over £15,000, payment is divided into three stages:

  • Deposit: 60% of the total price, covering upfront expenses like materials and accessories.
  • Upon Delivery: 30% of the total price, payable within one hour of delivery. Failure to pay will result in the product’s return and an additional delivery charge of £150, plus other fees.
  • Final Payment: 10% payable after completion and survey. If You cannot attend, the survey will be conducted by a Company representative, and the balance must be paid within 24 hours.

4.2.2 For standard products or bespoke products valued under £15,000, payment is split into two stages:

  • Deposit: 50% paid upfront.
  • Final Payment: 50% payable upon completion and survey. If You cannot attend, the survey will be conducted by a Company representative, and the balance must be paid within 24 hours.

4.3 We offer financing for our products through a broker. The broker contacts the customer directly to arrange financing. We are not involved in the process and only receive information on approval status.

4.4 If financing is approved, the customer must pay the full amount for our products and services upfront.

4.5 Delivery is free within a 20-mile radius. Beyond this, a charge of £0.30 per mile applies.

4.6 Prices are inclusive of VAT and exclude import/export duties.

4.7 Invoices are sent to the customer via email, providing updates on payments received.

 

  1. Right of Cancellation and Returns

5.1 You may cancel Your Order within seven (7) calendar days after signing the contract. However, if materials have been ordered, there is no refund for them. These materials can be delivered to You for a charge of £150 plus £0.50 per mile. Deposits are non-refundable. A new order will restart the process and may affect the price.

5.2 Deposits must be paid within 72 hours of order confirmation. Failure to pay cancels the Order.

 

  1. Cancellation by Us

6.1 We may cancel the Contract if:

  • Insufficient stock is available.
  • Issues arise with quality or supplier reliability.
  • Incorrect information (e.g., price, description) is discovered.
  • We suspect non-payment or non-compliance with these Terms.
  1. Delivery

7.1 Goods will be delivered to the address provided at the time of order.

7.2 Delivery will occur within 30 days unless otherwise notified.

7.3 Ownership transfers to You upon payment and delivery. Risk of loss or damage passes to You upon delivery.

 

  1. Liability and Limitations

8.1 We are not liable for defects unless You notify Us by email within seven (7) working days after delivery. Remedies include replacement, repair, or refund.

8.2 Our liability is limited to the price paid for the Goods.

8.3 We are not liable for indirect losses, including loss of profits or goodwill.

8.4 Nothing in these Terms limits Your statutory rights.

 

  1. Reporting Faults/Damage

9.1 Contact Us promptly via email (info@gardensolutions4u.com) with images of the issue. Delays in providing images may slow resolution.

 

  1. Events Beyond Our Control

We are not liable for delays or damages caused by circumstances beyond our control (e.g., strikes, floods, accidents).

 

  1. Governing Law

These Terms are governed by Northern Ireland law, and disputes shall be resolved by Northern Ireland courts.

 

  1. Complaints

Contact Us in writing before posting public complaints. We have 10 working days to respond.

 

  1. Guarantee

We provide a 5-year guarantee covering manufacturing faults, excluding third-party damage or extreme weather. The guarantee is non-transferable. To claim under the guarantee, the customer must present the invoice and original agreement signed by both parties.

 

  1. Clearance/Ex-Display Items

Sold as seen, with no guarantee or returns.

 

  1. Entire Agreement

These Terms constitute the entire agreement, superseding previous discussions or representations.

 

  1. Maintenance and Care Obligations

16.1 Customers are responsible for maintaining the Goods to ensure their longevity and performance.

16.2 We provide care instructions upon delivery. Failure to follow these instructions may void guarantees or warranties.

 

  1. Customer-Supplied Materials

17.1 We are not accepting customers to supply their own materials. Customers may specify preferred materials, but this is subject to negotiation. We may recommend alternative materials provided by our suppliers.

17.2 We do not use reclaimed materials supplied by customers. However, we are happy to provide new, good-quality materials.

 

  1. Storage of Goods

18.1 If You fail to take delivery of the Goods on the agreed-upon date, We reserve the right to store the Goods at Your risk and cost.

18.2 Storage fees will apply at £10 per day starting three (3) business days after the scheduled delivery date.

 

  1. Subcontracting and Third Parties

19.1 We reserve the right to subcontract any part of the production or delivery process to third parties.

19.2 We remain responsible for ensuring that subcontracted work meets the agreed-upon specifications and standards.

19.3 For landscaping, paving, and garden design services, including groundworks, additional subcontracting may be employed. Any additional charges incurred for subcontracting will be disclosed to the customer prior to work commencement.

19.4 We do not accept liability for damage caused to underground pipes, cables, or wiring if the customer has not provided clear and accurate markings. It is the customer’s responsibility to identify and mark these elements.

19.5 For electrical connections to the main power source, we may employ subcontractors. Additional charges will apply, and these will be communicated to the customer beforehand. Customers must provide an electrical connection equipped with an isolator installed by a certified electrician. An invoice or certificate must be presented upon request. If this is not provided, we reserve the right to call our contractor, and the cost will be added to the final invoice.

19.6 Similar terms apply to plumbing services provided through subcontractors, with costs agreed upon before commencement.

 

  1. Data Protection and Privacy

20.1 Any personal information You provide will be processed in accordance with Our Privacy Policy.

20.2 Your data will only be used for fulfilling Your Order and providing customer service unless You opt-in for additional communications.

 

  1. Intellectual Property

21.1 All designs, plans, and drawings created by Us remain Our intellectual property unless explicitly transferred in writing.

21.2 You may not replicate, distribute, or sell products based on Our designs without prior consent.

 

  1. Dispute Resolution

22.1 In the event of a dispute, both parties agree to seek mediation before pursuing legal action.

22.2 Mediation will be conducted by a mutually agreed-upon third party, and costs will be shared equally.

 

 

  1. Severability

23.1 If any part of these Terms is deemed unenforceable or invalid, the remaining sections shall remain in full effect.

 

  1. Amendments to Orders

24.1 Any requested changes to an Order must be submitted in writing and may be subject to additional costs and lead times.
